In Schmidt v. Washington Contractors Group, Inc., 964 P.2nd 34 (Mont. 1998), our client's personal injury claim was dismissed on the Defendants' Motions for Summary Judgment ten days prior to a jury trial. On appeal, the Montana Supreme Court, in a unanimous decision, reversed the District Court Judge and remanded the case for trial.
